REQUEST OF JOSEPH RIVARD OF 3083 SHOREWOOD LN , MC R M E O iomwwsm.
IDR REVIEW OF PREVIOUS COLI C LL ACTION ON ADJACENT FENCING
On Sept. 10, 19792 the Roseville Council reviewed the request for a special
pe i t for a fence by Dr. John Staffne of 3075 Shorewood Lane. At that time,
the council approved the special permit for the fencing with tha condition
that the fencing Oall meet the r e qu i remen t s of Sec. 13-080 of the city code
This section relates to the fact that the fence must have openings equal to
at least 5 of -its area to allow for~ the mo v ener t of air. It was concluded
that any portion of the fence within .the required I -e g a l setbacks for structures,
that has not received ved approval by the coat igfious neighbor adjacent to that
fence, will have to be altered. The only po rt i Dn of h-e fe roc lw ng that d1 d not
receive such approval and did not meet the requirements of Sec. 13,00 i' Dr
d.
openings was a small section adjacent to Mr. Ri va rd' s land to the north. Dr,
toff ne , therefore, altered this 10 feet of fencing running pe rpendi cu 1 ar fr w
Mr. R i v a r d' s property so that it did meet the code r equ i r emn is for percent
opening, The other, fencing either meets the code on percent of opening iz)r
received wr4i tten approval of the adjacent property owners
The other question raised at the time of the hearing was the height of the
fence. It is the opinion of the city's legal staff that the fence was to be
measured from the higher side and, therefore, as currently constructed, the
fence :,i s in accordance w1wth the city's s pet i i=i cati ons for heights
