<br />1 ORDINANCE #1320 <br />2 (PF 3634) <br />3 <br />4 AN ORDINANCE AMENDING TITLE 10 OF THE CITY CODE, SECTION <br />5 1014.04B4 BY REVISING THE REQUIREMENTS FOR NOTICE OF FINAL <br />6 DECISION BY THE VARIANCE BOARD TO ALLOW FOR ONE MAILED <br />7 NOTICE OF THE PROPOSAL AND INFORMATION ON HOW TO APPEAL A <br />8 DECISION OF THE VARIANCE BOARD AT LEAST 10 DAYS PRIOR TO THE <br />9 HEARING. <br />10 <br />11 <br />12 <br />13 <br />14 The City Council of the City of Roseville does ordain: <br />15 <br />16 Section 1. Section 1014.04B4 is hereby revised as follows: <br />17 <br />18 1014.04: BOARD OF ZONING ADJUSTMENTS AND APPEALS: <br />19 <br />20 A. Except as described in the subsection below (zoning variances), the City Council shall act as <br />21 the Board of Adjustment and Appeals <br />22 <br />23 B. Zoning Variances. The City Council shall annually designate nominate three members of the <br />24 Planning Commission to act as the Board of Zoning Variances Adjustments and Appeals <br />25 (hereinafter called the "Variance Board") pursuant to Minnesota Statutes Chapter 462. Requests <br />26 for variances shall be processed by the Community Development Director or designee in <br />27 accordance with the provisions of chapter 1 0 13 of this title or other relevant section of this code <br />28 and Minnesota Statutes 15.99. <br />29 1. The Community Development Director or designee shall provide written notice of the request, <br />30 as per Section 108 of this Code to all property owners within 350 feet prior to a hearing of the <br />31 Variance Board and shall publish notice of public hearing in the official newspaper at least ten <br />32 (10) days prior to said hearing. <br />33 2. A sign, available from the Community Development Director or designee, shall be placed by <br />34 the applicant on a portion of the property visible from the primary road frontage, stating that the <br />35 owner has a request before the Variance Board, the date of the hearing, and the city hall phone <br />36 number for further information. Such sign shall be placed at least ten (10) days prior to said <br />37 hearing. <br />38 3. Additional Information: The city staff shall have the authority to request additional <br />39 information from the applicant concerning operational factors or to retain expert testimony with <br />40 the consent and at the expense of the applicant concerning operational factors, said information <br />41 to be declared necessary to establish performance <br />42 conditions in relation to all pertinent sections of this Code. <br />43 4. When providing notice of the hearing, the Director of Community Development or designee <br />44 shall also mail information on how to obtain a copy of the final order of the Variance Board, and <br />45 a brief statement of the appeal procedure to tlpefrthe petitioner and as per Section 108 of this <br />46 Gede and to all property owners within the legal notice area prescribed in Section 108.
