1 ORDINANCE #1320 2 (PF 3634) 3 4 AN ORDINANCE AMENDING TITLE 10 OF THE CITY CODE, SECTION 5 1014.04B4 BY REVISING THE REQUIREMENTS FOR NOTICE OF FINAL 6 DECISION BY THE VARIANCE BOARD TO ALLOW FOR ONE MAILED 7 NOTICE OF THE PROPOSAL AND INFORMATION ON HOW TO APPEAL A 8 DECISION OF THE VARIANCE BOARD AT LEAST 10 DAYS PRIOR TO THE 9 HEARING. 10 11 12 13 14 The City Council of the City of Roseville does ordain: 15 16 Section 1. Section 1014.04B4 is hereby revised as follows: 17 18 1014.04: BOARD OF ZONING ADJUSTMENTS AND APPEALS: 19 20 A. Except as described in the subsection below (zoning variances), the City Council shall act as 21 the Board of Adjustment and Appeals 22 23 B. Zoning Variances. The City Council shall annually designate nominate three members of the 24 Planning Commission to act as the Board of Zoning Variances Adjustments and Appeals 25 (hereinafter called the "Variance Board") pursuant to Minnesota Statutes Chapter 462. Requests 26 for variances shall be processed by the Community Development Director or designee in 27 accordance with the provisions of chapter 1 0 13 of this title or other relevant section of this code 28 and Minnesota Statutes 15.99. 29 1. The Community Development Director or designee shall provide written notice of the request, 30 as per Section 108 of this Code to all property owners within 350 feet prior to a hearing of the 31 Variance Board and shall publish notice of public hearing in the official newspaper at least ten 32 (10) days prior to said hearing. 33 2. A sign, available from the Community Development Director or designee, shall be placed by 34 the applicant on a portion of the property visible from the primary road frontage, stating that the 35 owner has a request before the Variance Board, the date of the hearing, and the city hall phone 36 number for further information. Such sign shall be placed at least ten (10) days prior to said 37 hearing. 38 3. Additional Information: The city staff shall have the authority to request additional 39 information from the applicant concerning operational factors or to retain expert testimony with 40 the consent and at the expense of the applicant concerning operational factors, said information 41 to be declared necessary to establish performance 42 conditions in relation to all pertinent sections of this Code. 43 4. When providing notice of the hearing, the Director of Community Development or designee 44 shall also mail information on how to obtain a copy of the final order of the Variance Board, and 45 a brief statement of the appeal procedure to tlpefrthe petitioner and as per Section 108 of this 46 Gede and to all property owners within the legal notice area prescribed in Section 108.
