<br />City Council Regular Meeting - 04/25/05 <br />Minutes - Page 28 <br /> <br />date (as previously established by the City Council); pending <br />litigation and impacts to development of the proposed <br />documents; and scheduling orders established by a judge related <br />to pending litigation and first formal arguments scheduled in <br />June. <br /> <br />Councilmember Ihlan spoke in opposition to moving too quickly <br />at this stage; opining it was not in the public interest with <br />pending litigation. <br /> <br />Maschka moved, Schroeder seconded, adoption of Resolution <br />No. 10298 entitled, "A Resolution Calling for a Public Hearing <br />on the Modification of the Development Program for <br />Development District No.1, Modification of the Tax Increment <br />Financing Plans for Tax Increment Financing Districts No's. 1, <br />10, 11, 12, 13 and 16; Creation of Tax Increment Financing <br />District No. 17; and the Adoption of a Tax Increment Financing <br />Plan Relating Thereto, Creation of Hazardous Substance Sub- <br />district No. 17 A and the Adoption of a Tax Increment Financing <br />Plan Relating Thereto." <br /> <br />Councilmember Ihlan questioned why the City Council did not <br />have copies of the referenced modifications to the Development <br />Program for review. <br /> <br />The City's Development Attorney Jim Casserly advised that the <br />documents were in process at this time; as well as review of <br />existing City documents and TIF Plans referenced; noting they <br />would be provided to Councilmembers, with legislative and <br />time-sensitive changes incorporated, as soon as possible given <br />the extensive amount of review and drafting required. <br /> <br />Ihlan moved to strike paragraph 2.01 and add new paragraph to <br />the proposed resolution as follows: <br />2.01. "The City shall not consider Rottlund's application <br />for Tax Increment Financing or other public subsidies, or <br />agree to any Redevelopment Contract until Rottlund <br />reimburses the City for the City's legal, accounting, <br />appraisal, financial, engineering, architectural and other <br />consultants hired by the City to review the proposed <br />redevelopment project and its financing, as required under <br />
