Economic Development Specialist Cathy <br />Bennett confirmed that the spacing was consistent with that in <br />the project and along Terrace Drive. <br /> <br />Discussion included future construction at the Hamline Shopping <br />Center site and recent extension of the Concept Plan; and the <br />developer's need to install a new sidewalk or pathway at the time <br />of that redevelopment. <br /> <br />[6.1] <br />Maschka moved, Schroeder seconded, adoption of Resolution <br />No. 10282 entitled, "Resolution Approving the Livable <br />Communities Grant Funds for the Construction of Sidewalks, <br />Lighting and Landscaping as Part of the Arona-Hamline <br />Neighborhood Master Plan." <br /> <br />Roll Call [6.1] <br />Ayes: Kough, Ihlan, Maschka, Schroeder and Klausing. <br />Nays: None. <br /> <br />11. <br /> <br />Discuss Using Eminent Domain Authority (Condemnation) <br />for the County Road B-2 Pathway Project <br />Public Works Director Duane Schwartz provided background <br />review of this request. Mr. Schwartz noted the City is currently <br />completing plans and specifications for the construction of a <br />pathway along County Road B-2 between Lexington Avenue and <br />the westerly City limits, with construction scheduled for May of <br />2005. Mr. Schwartz noted that, in order to construct the project, <br />the City needed to acquire temporary and/or permanent <br />easements from 11 properties. Mr. Schwartz advised that three <br />easements remained outstanding: Triangle Warehouse, <br />JCPenney's and Rosedale, each requiring Council action. <br /> <br />Mr. Schwartz noted that staff had attempted numerous <br />discussions with property owners for these remaining easements <br />with no success; and requested initiation of condemnation <br />proceedings as requested. <br /> <br />Discussion included funding sources for the pathway project; <br />significance of requested time frame; PUD requirements with <br />Rosedale improvement plans; and the need to proceed as soon as <br /> <br />Resolution 10283 <br />Use of City <br />Property <br /> <br />Resolution 10284 <br />Eminent Domain <br />Authority <br />County Road B-2 <br />Pathway Project <br />
