<br />EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 31 st day of January 2005, at 6:30 p.m. <br /> <br />The following members were present: Maschka, Kough, Schroeder, Ihlan and Klausing <br />and the following were absent: none. <br /> <br />Council Member Maschka introduced the following resolution and moved its adoption: <br /> <br />RESOLUTION NO. 10278 <br />A RESOLUTION APPROVING THE VACATION OF AN UNDEVELOPED PORTION <br />OF THE WAGNER STREET RIGTH-OF-WAY (PF3599). <br /> <br />WHEREAS, Rollinger/Cartwright have requested the vacation of a portion of the <br />undeveloped Wagner Street right-of-way; and <br /> <br />WHEREAS, this section of Wagner Street right-of-way is 30 feet in width and 158.5 feet <br />in width and lies directly adjacent to 403 Wagner Street and 1823 Western Avenue; and <br /> <br />WHEREAS, the Public Works Department has determined that the requested road right- <br />of-way is no longer necessary, but that retention of a utility and drainage easement is necessary; <br />and <br /> <br />WHEREAS, the Parks and Recreation Commission, at their November 4, 2004 meeting, <br />voted to recommend to the Planning Commission the retaining the pathway easement for the <br />possibility of a future connection to Reservoir Woods, Ramsey County Open Space, Tamarack <br />Park and Lake McCarrons. <br /> <br />WHEREAS, the Roseville Planning Commission held a public hearing regarding the Easement <br />Vacation on October 6 and December 1, 2004 and voted (6-0) to recommend approval of the <br />requested 30 foot by 158.5 foot right-of-way vacation, based on the findings of Section 5and the <br />conditions of Section 6 of the project report dated December 1,2004; <br /> <br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to grant the <br />V ACA nON of certain PUBLIC RIGHT -OF - WAY, based on the findings in Section 5 and <br />Section 6 of the project report dated January 31,2005, and subject to the following conditions: <br /> <br />1. The retention of a 30 foot wide utility easement over the portion of street right-of- <br />way to be vacated. <br /> <br />2. The applicant must submit the legal description of the area to be vacated and the <br />proper legal document on which to record the vacation at Ramsey County, both to <br />be reviewed and approved by the Director of Public Works. <br /> <br />1 <br />
