EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF ROSEVILLE Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, County of Ramsey, Minnesota, was held on the 31 st day of January 2005, at 6:30 p.m. The following members were present: Maschka, Kough, Schroeder, Ihlan and Klausing and the following were absent: none. Council Member Maschka introduced the following resolution and moved its adoption: RESOLUTION NO. 10278 A RESOLUTION APPROVING THE VACATION OF AN UNDEVELOPED PORTION OF THE WAGNER STREET RIGTH-OF-WAY (PF3599). WHEREAS, Rollinger/Cartwright have requested the vacation of a portion of the undeveloped Wagner Street right-of-way; and WHEREAS, this section of Wagner Street right-of-way is 30 feet in width and 158.5 feet in width and lies directly adjacent to 403 Wagner Street and 1823 Western Avenue; and WHEREAS, the Public Works Department has determined that the requested road right- of-way is no longer necessary, but that retention of a utility and drainage easement is necessary; and WHEREAS, the Parks and Recreation Commission, at their November 4, 2004 meeting, voted to recommend to the Planning Commission the retaining the pathway easement for the possibility of a future connection to Reservoir Woods, Ramsey County Open Space, Tamarack Park and Lake McCarrons. WHEREAS, the Roseville Planning Commission held a public hearing regarding the Easement Vacation on October 6 and December 1, 2004 and voted (6-0) to recommend approval of the requested 30 foot by 158.5 foot right-of-way vacation, based on the findings of Section 5and the conditions of Section 6 of the project report dated December 1,2004; NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to grant the V ACA nON of certain PUBLIC RIGHT -OF - WAY, based on the findings in Section 5 and Section 6 of the project report dated January 31,2005, and subject to the following conditions: 1. The retention of a 30 foot wide utility easement over the portion of street right-of- way to be vacated. 2. The applicant must submit the legal description of the area to be vacated and the proper legal document on which to record the vacation at Ramsey County, both to be reviewed and approved by the Director of Public Works. 1
