Project No. 2004-152-M

Dear Mr. Noonan:

Per the Rottlund Homes' request, RLK-Kuusisto, Ltd. has prepared the following summary of the City of
Roseville's Shoreland Ordinance and B-6 Zoning Ordinance in relation to the Twin Lakes
Redevelopment site in Roseville, Minnesota. In addition, summaries of sanitary sewer capacity,
watermain adequacy and roadway capacity are also included, as well as a government approvals list and
site plan modifications requested for the site.

Shoreland Ordinance
Rottlund Homes has requested RLK review and analyze the consistency between the City of Roseville's
Shoreland Ordinance and the adopted concept master plan prepared for the Twin Lakes Redevelopment
Area. Langton Lake, which is part of the redevelopment area, is classified as a "General Development"
(GD) water body.

Chapter 1016 of the City Code relates to "Shore land, Wetland and Stonnwater Management". In
conversations with City of Roseville staff and consultants, it has been concluded that the Shoreland
Jurisdictional Zone, or that area of the proposed project that may be subject to the regulatory jurisdiction
of Chapter 1016, is that area within 300 feet of the Ordinary High Water Level (OHWL) of Langton
Lake. City staff and consultants also argue that the entire Twin Lakes Redevelopment Area and the Twin
Lakes Master Plan are not under the jurisdiction of Chapter 10 16. City staff and consultants also dismiss
the argument that the Shoreland Jurisdictional Zone includes an area 1,000 feet from the OHWL of
Langton Lake. These positions are mainly supported by the City Zoning Map, which illustrates the
"Water Management Overlay District" at approximately 3 00 feet from the OHWL of Langton Lake (see
attached Zoning Map).

Offices: Hibbing .
