Chief Sletner noted that, in current City Ordinance or Amplified Sound State Statute, there was nothing that specifically addressed and from Automobiles defined easily enforceable solutions, without the purchase of additional equipment. Chief Sletner noted that this proposed addition to City Ordinance 405.02 would establish up to a $50 fine, and was modeled after one recently initiated by the City of St. Paul. Discussion included effectiveness of such an ordinance; ticketing or warning of violations; Police Officer or Citizen complaint and verification for issuing a citation; seasonal issues related to noise concerns; footage requirements for citations; first course of action for verbal warnings; and defining residential and/or commercial parking areas. Councilmembers Schroeder and Kough expressed concerns regarding adoption of such an ordinance amendment without further discussion, information and consideration. Klausing moved, Schroeder seconded, tabling this item until the February 14, 2005 regular Council meeting for consideration of a First Reading of an ordinance entitled, "An Ordinance Amending Title Four, Section 405.02 Adding Section 405.02 H, Amplified Sound from Automobiles;" allowing the community to control abusive amplified sound from motor vehicles through the issuance of administrative fines as previously set forth by the City. Roll Call Ayes: Maschka, Kough, Schroeder, Ihlan and Klausing. Nays: None. Staff was directed to provide additional research and information to the City Council prior to that meeting.
