Beets, Roseville City Manager <br />Mayor and Members of the Roseville City Council <br />Dennis Welsch <br />City Staff <br /> <br />Background <br /> <br />In the presentation from city staff, I notice that the comparisons are always relative to the <br />AUAR. There appears to be a mistaken idea that the AUAR, as it was originally developed, IS <br />the basis to consider all development in the Twin Lakes area. This is incorrect. <br /> <br />The AUAR is a combination of two parts. The first part is the basic AUAR, which is a plan that <br />was developed by city staff detailing how the development in the Twin Lakes area should be <br />evaluated and how this development affected the area. <br /> <br />This basic plan was then sent to the appropriate state agencies to see if they agreed with the <br />position of city staff. MnDNR, in their review, found that the development plan proposed by <br />city staff was not in compliance with requirements for development near a lake. They insisted <br />that we must comply with the Roseville Shoreland Ordinance in any development near Langton <br />Lake. In response to the comments from MnDNR, the second part of the AUAR was developed <br />which is the Mitigation Plan. In the Mitigation Plan, Roseville stated that we would follow all <br />city ordinances in the development of the Twin Lakes area. <br /> <br />Both the AUAR and the Mitigation Plan were passed by the Roseville City Council on Aug 16, <br />2001. At this point the combination of the two documents became the controlling standard by <br />which to evaluate any future development. <br /> <br />There is a mistaken impression that the Roseville City Ordinances are not to be considered when <br />we evaluate new developments in the Twin Lakes area. The existence of the agreement in the <br />Mitigation Plan that Roseville would follow all city ordinances in the development changes these <br />ordinances from their normal position to instead be part of the AUAR requirements. <br /> <br />Summary <br /> <br />The present concept plan is not in compliance with the Mitigation Plan since it is not in <br />compliance with Roseville's Shoreland, Wetland, and Storm Water Management Ordinance ( <br />also called Shoreland Ordinance).
