Anderson, Esq. <br /> <br />Dear Fellow Council Members and City Attorneys: <br /> <br />We are writing this letter to explain why we disagree with the city attorney's opinion that <br />the city council can approve Rottlund's proposed redevelopment for Twin Lakes without <br />amending the City of Roseville's Comprehensive Plan. The reasons are very simple. <br />Rottlund's proposal violates the Twin Lakes Master Plan, which the city council adopted <br />as part of our city Comprehensive Plan in June 2001. Anyone who reads the Plan can see <br />this. It specifically recommends against big box and strip mall development in the Twin <br />Lakes area. The "master site plan" map that Rottlund is asking the council to amend is <br />the AUAR map, which is also part of the Comprehensive Plan. The council can't change <br />parts of the Comprehensive Pla.n, or approve proposals that violate the Comprehensive <br />Plan, without amending the Comprehensive Plan. <br /> <br />Furthermore, the Rottlund proposal is inconsistent with the 8-6 Business Park zoning <br />that the Comprehensive Plan requires for the Twin Lakes area. The Comprehensive Plan <br />calls for only "limited" support retail in the B-6 Business Park. What Rottlund is <br />proposing is a new regional shopping center, not limited support retail. Rottlund's <br />proposed retail center does fit our shopping center ordinance. But, according to our <br />community development staff, the council would need to amend the Comprehensive Plan <br />to zone the Rottlund development as a shopping center. <br /> <br />Minnesota statutes require a 2/3 majority (or a 4/5 vote of our council) to amend a city <br />Comprehensive Plan. We believe that if the council tries to approve the Rottlund <br />proposal without amending the Twin Lakes Comprehensive Plan (and without a 4/5 <br />vote), we will be breaking state law.
