<br />City Council Regular Meeting - 01/31/05 <br />Minutes - Page 13 <br /> <br />Nays: None. <br /> <br />4.d Second Reading of a Twin Lakes Rezoning Ordinance <br />(Consent Item 3.m) <br />Mayor Klausing noted that, in the opinion of the City <br />Attorney related to the 60-day ruling on land use cases, a <br />second reading was not necessary, but in an effort to clear <br />any ambiguity related to this matter, the City Council had <br />provided a second reading. <br /> <br />Councilmember Ihlan restated her rationale for opposition <br />to the motion based on her interpretation of zoning <br />amendment legislation. <br /> <br />Councilmember Kough restated his rationale for opposition <br />to the motion based on his interpretation that a 4/5 vote of <br />the City Council was required for Comprehensive Plan <br />amendments. <br /> <br />Maschka moved, Schroeder seconded, holding a second <br />reading of an Ordinance entitled, "An Ordinance <br />Amending Title 10 of the City Code, Changing the Zoning <br />Map Designation of Certain Real Property within Twin <br />Lakes Phase I from B-1, B-4, and I-I and 1-2 to Planned <br />Unit Development with an Underlying Zoning of B-6 <br />Mixed Use Business Park District;" rezoning the Twin <br />Lakes Phase I parcels to a Planned Unit Development <br />(PUD) with an underlying zoning ofB-6. <br /> <br />Roll Call <br />Ayes: Maschka, Schroeder and Klausing. <br />Nays: Kough and Ihlan. <br /> <br />Mayor Klausing noted that the Ordinance would not <br />become final until the final Concept Plan had been <br />approved by the City Council. <br /> <br />5.
