<br />City Council Regular Meeting - 01/31/05 <br />Minutes - Page 26 <br /> <br />Recess Recess <br />Mayor Klausing recessed the meeting at approximately 8:43 p.m. <br />and reconvened at 8:53 p.m. <br /> <br />John Kysylyczyn, 3083 N Victoria Street <br />Mr. Kysylyczyn attempted public comment related to the <br />previous discussion, but was not recognized by the chair on <br />advice of legal counsel. <br /> <br />6. <br /> <br />Consider a Request by Sue & Jay Rollinger and Anne & Ray <br />Elias-Cartwright for a Street Right-of-Way Vacation of a <br />Portion of Wagner Street (PF 3599) <br />Community Development Director Dennis Welsch and City <br />Planner Thomas Paschke briefly reviewed the request; noting <br />that representatives of both parties were in attendance at <br />tonight's meeting. <br /> <br />Mr. Paschke advised that the Planning Commission, at their <br />October 6, 2004 meeting, had continued this case until the Parks <br />and Recreation Commission's review of retention of the trail <br />easement. Mr. Paschke noted that the Parks and Recreation <br />Commission had approved the vacation of the right-of-way, with <br />retention of the utility and pathway easements. <br /> <br />Ray Cartwright, Applicant/Property Owner <br />Mr. Cartwright spoke highly of their interactions during the <br />process with the Parks and Recreation staff and Commissioners; <br />and expressed appreciation for the City's parks. Mr. Cartwright <br />opined that, while they would prefer not to keep the trail <br />easement in place, he recognized the rationale of staff and the <br />Commission. <br /> <br />[7.6] <br />Maschka moved, Kough seconded, adoption of Resolution No. <br />10278 entitled, "A Resolution Approving the Vacation of an <br />Undeveloped Portion of the Wagner Street Right-of-Way (PF <br />3599)." <br /> <br />Discussion included a history of vacations on the other side of <br />the street; and potential for future construction and location of a <br /> <br />Resolution 10278 <br />Sue & Jay <br />Rollinger and <br />Anne & Ray Elias- <br />Cartwright <br />Street Right-of- <br />Way Vacation of a <br />Portion of Wagner <br />Street (PF 3599) <br />
