City Council Regular Meeting - 01/31/05 Minutes - Page 26 Recess Recess Mayor Klausing recessed the meeting at approximately 8:43 p.m. and reconvened at 8:53 p.m. John Kysylyczyn, 3083 N Victoria Street Mr. Kysylyczyn attempted public comment related to the previous discussion, but was not recognized by the chair on advice of legal counsel. 6. Consider a Request by Sue & Jay Rollinger and Anne & Ray Elias-Cartwright for a Street Right-of-Way Vacation of a Portion of Wagner Street (PF 3599) Community Development Director Dennis Welsch and City Planner Thomas Paschke briefly reviewed the request; noting that representatives of both parties were in attendance at tonight's meeting. Mr. Paschke advised that the Planning Commission, at their October 6, 2004 meeting, had continued this case until the Parks and Recreation Commission's review of retention of the trail easement. Mr. Paschke noted that the Parks and Recreation Commission had approved the vacation of the right-of-way, with retention of the utility and pathway easements. Ray Cartwright, Applicant/Property Owner Mr. Cartwright spoke highly of their interactions during the process with the Parks and Recreation staff and Commissioners; and expressed appreciation for the City's parks. Mr. Cartwright opined that, while they would prefer not to keep the trail easement in place, he recognized the rationale of staff and the Commission. [7.6] Maschka moved, Kough seconded, adoption of Resolution No. 10278 entitled, "A Resolution Approving the Vacation of an Undeveloped Portion of the Wagner Street Right-of-Way (PF 3599)."
