<br />City Council Regular Meeting - 05/09/05 <br />Minutes - Page 2 <br /> <br />Mayor Klausing suggested the request could be discussed <br />at a future Council Study Session; and sought City <br />Attorney comment. <br /> <br />City Attorney Jay Squires advised that such a ballot <br />question would be deemed an improper expenditure of <br />public funds, but that he would need to do further research <br />to determine if other impediments were apparent in <br />considering such a ballot referendum. <br /> <br />City Attorney Squires was directed to prepare a formal <br />written opinion at his earliest convenience, if possible prior <br />to the Council's next scheduled Study Session; and directed <br />staff to include discussion on the Study Session agenda. <br /> <br />B. AI Sands, 2612 Aldine <br />Mr. Sands requested the City Council's continued <br />discussion at a future Council Study Session, or via a staff <br />informational meeting with the James Fourth Addition <br />neighborhood to reignite interest, discussion and ultimate <br />consensus of the neighborhood related to future <br />improvements. <br /> <br />Mr. Sands also addressed two acres of "park land" <br />identified as part of proposed Twin Lakes Tax Increment <br />Financing (TIF) District No. 17; and questioned current and <br />future proposed zoning (from Park/Open Space to B-6). <br />Mr. Sands expressed his disappointment with and <br />perceived betrayal of the Community Development <br />Department in violating City ordinance and including this <br />park land in the development plan. Mr. Sands admonished <br />Councilmembers to review and correct the matter; and <br />encouraged citizens to contact Councilmembers to voice <br />their disappointment in staff s attempt to convert park land <br />into commercial property. <br /> <br />Community Development Director Dennis Welsch <br />Mr. Welsch explained that the property in question had <br />been purchased by the City with TIF proceeds for storm <br />water retention, specifically for the roadway designated in <br />
