Squires Usquires@ratwiklaw.com]
Thursday, June 02, 20059:51 AM
Margaret Driscoll
FW: Your comments as documented in the minutes of 5/9/05 re: ballot referendum for Twin
Lakes

I have reviewed the minutes. They are not inconsistent with my recollection of my
comments. As I recall, a citizen (Mr. Hauk?) got up during the comment period and talked
about Twin Lakes. He suggested I had opined that there were no legal impediments to an
advisory election, so long as it was privately funded. The issue had first corne up late on
the evening of the Town Hall meeting held at the school by Concordia Academy. I recalled
offering my off the cuff comment that the issue raised public purpose expenditure issues,
and that it was in the nature of initiative and referendum. When the citizen quoted me, I
clarified that I had not done any thorough research, and that there may well be other
impediments that needed to be reviewed. We conducted the research, and had the written
opinion for the Council the following Monday.

Given my above recollection of things, I believe the minutes accurately reflect the
discussion.

The information contained in this electronic message is attorney-client privileged and
confidential information and is intended only for the use of the individual(s) to whom
this electronic message is addressed.
