UNE BUILDING <br />,11977 <br />CITY O-V <br />OA% qWP <br />U;V, �. } <br />Moseville Ordinance 72,190 (2) provides,: <br />"It shall be the responsibility of the owner <br />or occupant to maintain the sewer service <br />from the main sewer into the house or building.1 <br />The apparent rationale for that ordinance is that the cost o <br />maintaining the pipe between the ' house and the main line is <br />part of the price the customer pays to use the system, In <br />our opinion such a requirement is constitutional and -legal. <br />Such ordinances are quite common throughout the inetropolitan <br />area, I <br />The City has in the past established a policy whereby the <br />City will undertake the cost of maintainiLng the sewer lines <br />if the damage to the line is caused by the negligence of the <br />City. There does not appear to be any such claim involved <br />in this case unless Mr. Miletich 'is claiminq that the decision <br />
