The property in question is the land that Paul Raberts recently requested <br />be rezoned ia the R-6 Townhouse Dis'trict for the purpose of constructing <br />24 townhouse units. You will recaZl that 11 of ihose townhouse units <br />were to be oriented tawards Albemarle Street and the remair�der towards. <br />Rice Street. The Cauncil denied ihat petition based primarily on their <br />reluctance to convert business zoned land (S-1) for resideniial <br />develo�ment. There was a�so concern expressed by the neighbors regarding <br />the increase in traffic from the 11 units proposed �o be oriented tou�lards <br />Albemarle Street_ <br />2. The total property involved (between Albema�rle Street and_Rice 5treet} is <br />2.18 acres. Pir. Roberts �roposes at this time to rezone the westerly .876 <br />acres from B-1 to R-2, and plat th� land into faur duplex lo�s. Each af <br />the duplex lots would have a frantage of 83.75 feet (85 feet required) and <br />a depth af 114 feet. Each lot would have a 1and area of 9,547.5 �eei <br />{11,000 sguare feet required). The dif�erences between the proposed lat <br />sizes and the m�nimum required in the ordinance we feel are not significant. <br />If the land is to be developed far duplex purposes, we feel that �he <br />subdivision as praposed is a reasonable ane. <br />3. The westerly 33 feet of the land is a vacated portion of Albemarle Street <br />(60 feet of Albemarle Street still remains to the west). Previous rezoning <br />indicated this vacated portian ta be zaned R-2. l�e have since researched <br />this question more fully. The City Attarney advises �s that this vacated <br />portion of Albemarle Street is in fiact zoned B-1, ;rhich is t�e zoning of <br />tl�e con�iguo�s oraperty. The land to the west, acrass Albemarle Street, <br />is zoned R-2. <br />4.
