AGENDA SECTION :
REQUEST FQR C4UNCIL ACTION
pRIGINATING DEPT./pIV.:
Reports Rcomnendations Adm
iM NO.: E7EM DESCRlPT10N:ji+fjT PI'OpeT"t1eS request £or rezaning from I-1
E-3 to I-2 and special use permii at 1920 CoLmty Road C
MEETING 7-12-76
DATE:
DEPT. HEAD.APPROVAL.
MGR
The Planning Conunission at its July 7, meeting took the following action
Properzes request:
. REVIEWED/RECOMMENDS: I
.-;—'n I
on MAT

Mr. KeTlett moved and Mrs. ishing econded, that the Commissian
reconend denial. of MAT Properties request for rezonzng from I-1
to I-2 and special use permif at 1920 County Roa C and also re-
conend that the City Council consier including truck renta2 as
a special use in the I-1 zaning districfi; further, that if the
Comcil approve truck rental as a special use in I-1 zoning, the
Comnission wou1 reconsider $is rec{uest and if recmnmended for
approval would recommend a Iamited period of time for the permit.
Ro11 Call, Ayes: Mastel, Cushing, G. Johnson, Kellett an V. Johnson.
Nays: Simons.
Mr. Kellett moved and Mrs. G.tshing seconded, tha.t the Commission
would recanunend approval af MAT Properties would request a special
use pennit for a truck rental operation in I-1 zoning at 1920 County
Road C with the condition that the rmii expire three years after the
date of approval.
The Corrnission was opposed to recoending approval of the rezoning to T--2 £or this
property. However, because of the circiunstances suxround.ing the Teasing of the property
they recol►unended that the Cowicil again consider including truck rental as a secial use
in the I-1 zoning district. They fe1 tha.t if this were done they could probably recammend
approval of he special use permit for a period of three years. (which is the length of
the lease that the Gi1-F1ex truck rental firm has on the property).
The Conunission adopted the second motion above to avoid recuiring the applicant to
return again to the Cornnissi.on should t.he CoLm.cil decide to include truck rental as a
special use in the I-1 zone. They adopted the motian with the l.uiderstanding that we
wauld check with the City Attorney to determine if the Co sion coud make a re-
comnendation regarding the special use in the I-1 zoning i he publicatian provided
for rezoning to I-2 and special zse. The atitorney in.icates that if the Council amends
the ordinance to in.clude rruck rental as a special use in T-1 that the praperty owner
would be required to submit a new application and have it referred to the Planning
Commission for reconendation. The follawing are som, o£ the alternative actions the
council may wish to cansider.
1. Establish a public hearing on MAT Propexties rec{uest for rezoning from I-I to
to I-2 and special use permit a I920 Caty Road C.
2. Adopt an ordinance establishing truck xental as a special use in the I-1 zone and
referring application from MAT Properties for a special use permit at 1920 County
Road. C to the Planning Gorrission meeting of August 4.
3: Continue the application.
