If the Council instructed the Attorney to prepare that <br />ordinance it wou�d then be appropriate to refer this request to the Planning <br />Conmissian. If the CaLmcil decides not to pursue the ordinance amen�nent, the <br />request shoul.d not be referred. This is a praposed joint venture between <br />Mrs. Marie Slawik and Dr. Thomas Votel to construct a medical bu�.lding on the <br />south partion of the Ha.r Mar Mall property which is presently zone� R-1. (The <br />applicant is requesting that the Coimcil public hearing be advertised for August 9). <br />6. A1]ied Stores request £or preliminary plat "LaBelle's Addition", rezoning from I-1 � B-� <br />to B-1 and B-1-B, special use pennit and variances to sign size and parking require- <br />ment at 1750 West Highway 3(. The praposed development includes a LaBe11e Catalogue <br />Show Room, Franks Nuraery and a Learning Tree Day Care Center. The City Attorn.ey <br />will be prepared to comment this evening regarding the fact that the Coimcil in <br />Ma.y denied A11ied Stores request for rezoning for the LaBel�e's Catalogue Show Rntim. <br />Section 16.050 0£ the City Code provides that no person, firm or corporation shall <br />b� entitled to presenr any petition for ihe rezoning of land within 6 months from <br />the receipt af a petition seeking substarxtiaZly the s�ne rezoning where such original <br />petztion has been ena.cted �on and d.enied.
