City Manager Beets responded, at the direction of Mayor Klausing, that staff had hoped to avoid controversy, and in light of receipt of only one (1) application for one (1) vacancy, had sought Council approval of that appointment. Mr. Beets noted that a City Attorney legal opinion was pending as to whether Resolution 9372 was still governing City Rules and Procedure, or if action after its adoption had superceded its authority. Mr. Beets advised that, while awaiting that opinion, staff sought not to impede this appointment. Mayor Klausing noted that the argument could be made that this was not consistent with past procedure, but he was comfortable with this particular appointment. Mr. Kysylyczyn further addressed Resolution 9372 regarding advertising vacancies prior to an application deadline and the interview process Roll Call Ayes: Schroeder, Maschka, Kough and Klausing. Nays: None. 3.2 Waive First Reading, Conduct Second Reading and Enact Zoning Map Amendments, Parks Section 1002- 1011 (PF 3539) Maschka moved, Schroeder seconded, waiving the first reading, holding the second reading and approving ordinance No. 1300 entitled, "Amending Title 10 of the City Code, Changing the Zoning Map Designation of Real Properties Owned by Public Entities throughout the City of Roseville from Assorted Zoning Districts to Park and Open Space (POS) Zoning District (PF 3539)" rezoning assorted City- and County-owned Park and Open Space Parcels from "R-1 " "4-3A " "B-1" "PUD " and "1-1 " and , , , , , "1-2," to "POS" (Park and Open Space Zoning District) as shown on the attached map dated January 26, 2004, and listing of each parcel identification number and the existing zoning on that parcel.
