The complaint was based on the fact that it was a re�aii operation and <br />occurring in a residenti.al axea. Based on the cos►�plaint, the Code Enforcemen� Officex <br />advised the 1adi.es that they could not conduc� such an activity. The Ciiy Code makes no <br />provision far such sales. <br />Subsequent to the meeta.ng with the citizens, Mr. Dahlgren prepa.red a suggested amencl�nent <br />to the City Code which would permit g�rage sa�es and boutxque sales. He also ma.de the <br />follawing co�ents: <br />J�. The changes to the zoning code are suggested with the objectzve that garage <br />and bo�tique sales be allowed on a iimzted basis on certain residential <br />pxopert�.�s as a reasanable exercise of propexty rights in a manner so as ta lamit <br />the potential deleterious effects of misuse of the practice. <br />2. I� zs reco�i.zed that the conduct af a sale of used items of houseware an.d home- <br />making by residentia]. neighbars for other farnilies is a useful custam becom�g <br />increasi.ngJ.y popular for both seller and buyer. Likewise, it �s asswnec� that the <br />infrequent sale of hand cxafted items in a residence, �f done on a reasonable basis, <br />can be useiul and hLUnanly rewarding ente�arise. <br />3, It a.s, however, assumed that the frequent conduct o� such sales at a part�c�.lar <br />residence can become a neighboxhood nuisance aaversely a£�ecting the 1ivi.ng <br />enviroiunent in a typical res�.denta.al neighborhood. <br />4. Ac�ion to control such sales is suggested. at this time due to the wide interesfi <br />shown �.n such activities in recent years in the suburban conantu�zties of Mznneapolis <br />and St. Paul and the registration of complaints in�some znstances where the <br />privilege has apparently been abused, <br />I� was intended ta keep the ordinan�e as si.mple as possible. The basic provisions <br />are that each residential unit may have one garage sale ana ane boutique sale per year <br />and �hat each saZe may not exceed 3 days in duration. <br />The suggested ordinance was reviewed with the Gity Attarne� and he prepared the at�ached <br />ordznance in final form. <br />i wouZd an�icipate that thexe wi.Il be several individuals at the Counci� meeta.ng who are <br />zn���ested in tTiis ordznance. <br />If the Council decides ta adopt the ordinance, the foZlowing motion is suggested: <br />Motion adop'ting ardinance amending Section 7.025 of the City Code o£ <br />the Ci�ty of Raseville relating to the pex�rni�ting of garage sal.es and <br />resi.dential boutique sales in. residenta.al districts. <br />
