<br />() () <br />~P-,2".._"-..",, <br /> <br />Date: 07/18/05 <br />Addendum to Item: 7, <br /> <br />To: Roseville City Council <br />From: Neal Beets <br />Re: Councilmember Ihlan's Questions <br />about Environmental Clean-Up <br />Date: Friday, July 15, 2005 <br /> <br />City of <br /> <br />. <br /> <br /> <br />Minnesota, USA <br /> <br />Attached is a memo from Community Development (Dennis Welsch \ Cathy <br />Bennett) responding to Councilmember Ihlan's questions. <br /> <br />I write to add those paragraphs from the Twin Lakes Redevelopment Agreement <br />dealing with environmental remediation, with key provisions underlined. <br /> <br />........... ...... ................. ........... ....... ................... a. <br /> <br />From City-Rottlund Redevelopment Agreement, approved June 20, 2005 <br /> <br />Section 5.5. Environmental Remediation. <br /> <br />(a) The Redevelopment Property is contaminated with certain Hazardous <br />Substances. The plans for remediating the contaminated portions of the Redevelopment <br />Property will be deseribed in the Approved Response Action Plan. <br /> <br />(b) The City shall make available to the Redeveloper all existing reports, as- <br />sessments and other data in the possession of the City relating to the soils and environ- <br />mental eonditions of the Redevelopment Property. <br /> <br />(e) With respeet to Parcels under eondemnation when the City has obtained eon- <br />sent from the property owner or a eourt order permitting inspeetion, the Redeveloper and its <br />agents and designees are granted permission to inspeet, analyze, and test such Parcels to the <br />extent permitted by Minnesota Statutes, Section 117.041. The Redeveloper shall hold the <br />City harmless from any liability resulting from the Redeveloper or its agents or designees <br />entering upon such Parcels or performing any of the tests or inspections referred to in this <br />subparagraph. <br /> <br />(d) The Redeveloper shall have the sole responsibilitv for Environmental <br />Remediation and soils correction and shall bear all costs associated therewith. The Re- <br />developer shall perform the Environmental Remediation pursuant to the Approved Re- <br />sponse Action Plan. The Redeveloper intends to seek a No Action Letter from the <br />MPCA, but inability of the Redeveloper to obtain a No Action Letter shall not excuse the <br />Redeveloper from any of its obligations hereunder. <br />
