� <br />� <br />.AN <br />CODE OF THE <br />OF GRANTING <br />VILLAGE QF ROSEVTLLE <br />�RDINANCE NO. 712 <br />� <br />* <br />ORDINANCE ADDTNG SECTION �2.Q55 TO THE VILLAGE <br />ViLLAGE QF ROS�VILLE PROVID�NG FOR THE PROCEDURE <br />MINOR VA.RIANCES AND DEFINING MINOR YiARIANCES . <br />The Village Counczl of the Village of Roseville does <br />Mexeby ordain: <br />I. <br />The V.illage Code of the Va.].�.age of RoseviZle is here'�ay <br />amended ]�y addzng Section 12.055, to :read as follows: <br />12.055. Procedure �or Minor Variances, An ow�ner <br />o� l.and may �ile an applicat�.on �or a manor varianc� <br />as�defined i.n Paragraph A below by paying a�ee of <br />$25_00_ The application sha7.1 then be referred to a <br />board as set forth in Paragraph B, and in the event <br />that the board unanimous�y approves said variance <br />the varianc� may be gxanted by the Village Council. <br />Yn the event the application is z�ot unanimous�y <br />appraved by the board,then and in that event the <br />applicant may proceed as provided in Section 12_050 <br />ar�.d the $25.OQ fee sha1� be applied to the �ee as <br />requi.red i.n Section 3.2 _050. <br />A. A"minor varaance" �.s a variance in ei,ther <br />R-1 ar R-2 districts only and refers to front and <br />side yard set backs. <br />B. Be�ore the board may conside� such minor <br />varianc� application, the appla.cant sha�1 se�ure and <br />present wx�itten statements from awners o�' propeacty <br />cont�.guaus to the affected yard �ox which the varzance <br />is requested, specificaily noting no objection and <br />consenti.ng to such minox varz.ance.. Th� board shal� <br />determine wzthout an abstract or ce�tificate the <br />names of such property owners_ <br />C. The boa�rd shall schedul.e an adma.nistrative <br />heari.ng, the time and p�.ace fax- which shall be set <br />by the Manager. The appl�cant and contiguaus pxopexty <br />o�nna.ers to the affected yard �hall be �.oti.�i�d. of such <br />time and place in wrYting not less than five (5) days <br />prio� to such heari.ng. The Manager may ixi�orm <br />additional property owners as he may �eel merit an <br />interest ir� the proceedings. <br />
