C <br />l <br />� <br />� <br />VILLAGE OF R05EV�LLE <br />ORD�N�NCE N�. 712 <br />* <br />AN ORDINANCE ADDING SECTION 12.055 TO <br />CODE QF THE V�LLAGE OF ROSEViLLE PROVID�NG FOR <br />OF GRANTING MINOR VA.RIANCES AND DEI'YNZNG M�NOR <br />* <br />THE V�LLAG� <br />THE PROCEDURE <br />VARIANCES. <br />The Village Co�ncil of the Va.�7.age af Roseville daes <br />hereby ordain: <br />I. <br />The Village Code of the Village af Rosevi.Zle is hereby <br />amended l�y adding Section 12.055, to read as �allows: <br />12.055_ Procedure for Ma.nor Vari.ances. An owner <br />af land may file an application for a minor variance <br />as defined in Paragraph A below by paying a�ee of <br />$25.00. The application sha1.1 then be referred to a <br />board as set forth in Paragraph B, and zn the event <br />that the board unani�nously approves said variance <br />the variance may be granted 7�y the Village Council. <br />In the event the application is not una�imous�y <br />appraved by the board,th�n and in that event the <br />applicant may proceed as pxova.ded in Section ].2_050 <br />and the $25.00 �ee sha11 be applied to the fee as <br />xequxred in Section 1.2.050_ <br />A. A"minor variance" is a�crariance zn either <br />R-� or R�-2 districts oniy and refers to front and <br />side yard s�t }�acks . <br />B. Before the boaxd may consi�der such minor <br />variance application, the appZicant shall secux�e �nd <br />present written statements from oG,rners of property <br />con.tzguous to the affected yard �'or which the vari.ance <br />is requested, specif�.caZly noting no objection and <br />consenting to such minor var�ance. The boaxd shall <br />determine without an abstract or ce�tificate the <br />names o� such property owners. <br />C. The boax�d sha11 schedule an administrative <br />hearing, the time and place for which sha11 be set <br />by the Manager. The applicant and contiguous propexty <br />owners to the affected yard shal�. be notified ot su�h <br />time and place in. writi.ng nat ].ess than fiv� (5) days <br />prior ta such hearing. The Man�ger may inform <br />additi.onal property owners as he may fee�. mexzt an <br />i.ntexest in the proceeding$. <br />
