Further discussion included pond access; additional refinement of Concept Plan related to stormwater containment and drainage; and potential easement requirements. Public Works Director Duane Schwartz noted that the existing plan drains the front yards to the north, by incorporating rain water gardens adjacent to Parker A venue; with the back yards draining to the southeast. Mr. Schwartz noted staff concerns and their feedback to the applicant regarding drainage issues and underground infiltration. Councilmember Ihlan reiterated her previously-stated concerns to modify the policies which protect the City from this type of request for piecemeal developments without a Master Plan. She explained the need for Council consideration to ensure a unified scheme to accommodate community interests. Councilmember Ihlan referenced sections of the City Code related to health, safety, and general convenience considerations the Council could employ to deny the request. Discussion ensued regarding land use ordinances and legal interpretations; and compliance with those ordinance provisions. City Attorney Anderson discussed the City Council's options under City Code; timing, and their authority to regulate the Preliminary Plat; and whether the request would be deniable. Mayor Klausing opened the meeting to public comment. Bill Kuhbander, 1016 Parker Avenue Mr. Kuhbander addressed traffic concerns on Parker Avenue - existing and anticipated; as well as the current wildlife refuge surrounding the properties. Mr. Kuhbander opined that this development would devastate his property; and stated his adamant opposition to the proposal.
