<br />City Council Study Session - 01/23/06 <br />Minutes - Page 19 <br /> <br />affected property; and the greatest number of owners of property <br />situation wholly or partially within the following: <br />a) 350' of the outside boundaries of the property in question; <br />or <br />b) two complete adjacent properties, as measured <br />perpendicular to the boundaries of the property in question <br />(including properties that lie across streets or public rights- <br />of-way that are adjacent to the property in question); or <br />c) A distance outside the boundaries of the property in <br />question that equals the greatest total width dimension of <br />the property in question." <br />Mr. Roe opined that this was a way to achieve objectives of staff <br />and Council, as a best effort attempt to accomplish maximum <br />notification for a pending project. <br /> <br />Councilmember Maschka questioned whether there was actually a <br />problem that existed; and noted the additional notification for <br />comprehensive and complex projects (i.e., Twin Lakes). <br /> <br />Councilmember Kough spoke in support of Mr. Roe's suggested <br />policy. <br /> <br />Mayor Klausing requested staff s criteria for deviating from <br />standard practice and increasing the notification area. <br /> <br />Mr. Welsch advised that there was no written criteria used by staff, <br />but depending on the neighborhood and physical boundaries, <br />discretion was used in whether the notice area should be expanded. <br /> <br />Mr. Welsch concurred with Mr. Roe's proposed notice policy; by <br />using the greatest dilnension of the staff; and opined it would be <br />an easy solution for staff to follow. <br /> <br />After further discussion, it was the Council consensus to direct <br />staff to utilize the notice outlined by Mr. Roe, in addition to State <br />Statute 462.357, Subd. 3. <br /> <br />6.
