I know they are not your preferenc e but, all things <br />considered, I thought this was the best approach. <br /> <br />I do have a solution for the future. Or actually, the Code has a solution. Nothing in the Code authorizes me to <br />hear these appeals when violators object to the penalty set forth in the Code. The Code says the appeal is to the <br />Council. I don't think that is a very wise use of Council time and resources...but the law is the law. <br /> <br />Therefore, please modify the violation letter to indicate that liquor establishments may appeal the violation to <br />the City Council by sending a letter to you by a certain date. The letter should include a summary from the <br />liquor establishment about the factual or legal basis for their appeal. Then, we need to agendize the item for a <br />Council Meeting and do a short RCA explaining the violation; the City Attorney will have to do or say <br />something about the scope of the Council's authority to modify the penalty set forth in the Code. <br /> <br />Thanks. <br /> <br />1 <br />
