Pollution Control Agency {MPCA) Voluntary Investigation and Cleanup (VIC) Unit to respond to the question of "why the city must wait for redevelopment to occur to address contamination or why can't the city or MPCA force the cleanup of a contaminated Site". You also asked the MPCA staff to "address petroleum versus hazardous substance cleanup and to clarify if a higher standard of cleanup is required for residential rather than commercial uses". These are very gaol questions and the s~.nswer is a rather complex'one. VrC and VI'IC The MPCA typically addresses the majority of brownfields contaminated sites within the City in one of two separate, but related remediation programs. The first being the VIC program which addresses hazardous substance releases and ~is authorized by the Minnesota Environmental Response and Liability Act (MERLA) under Minn. Stat. § 115B. The second is the Voluntary Petroleum Investigation and Cleanup (V.PIC) program which addresses petroleum releases and receives its authority from Minn. Stat. § 115C, the Petroleum Release Act. Coordinated approach Many voluntary cleanup sites have both petroleum and hazardous substance releases, which require involvement and a coordinated approach between the VIC and VPIC staff. Wb.en a Site is addressed under either of these programs the MPCA staff use a risked based approach and assurances are issued which typically address the existing and, if known, proposed land use scenario. .addressing Changing Land ~Jse The MPCA establishes conditions or places disclaimers into assurance letters to address existing, ox if known, changing land use. For example, an industrial VIC site which proposes to leave contamination above criteria in the top four feet in gr~~ssy areas, must file a declaration of restrictions on the land that prohibits persons from disturbing the 1,3nd without first receiving the approval of the MPCA Commissioner. 520 Lafayette Rd.
