City Council Regular Meeting - 08/09/04
Minutes -Page 9
Councilmember Ihlan expressed her concern that given the
requested action at tonight's meeting, without a Public Hearing
being provided for additional and substantive public comment,
she was recommending that the Council focus tonight's
discussion on the financial feasibility of the project.
Councilmember Ihlan further opined that the Council was being
forced to make numerous incremental decisions without that
comment being received; and questioned whether the process
was protective of public and/or City interest.
Mayor Klausing recommended hearing the reports and updates
this evening, along with staffs response; and to schedule a
separate time for public continent in a Council setting.
City Manager Beets responded to Council comment by noting
that this item had been listed on the meeting agendas numerous
times; e-mails, letters, faxes and verbal comment had been
provided to the City Council, including those written comments
included in tonight's Council packet, as well as the public
corr~ment heard at each meeting. City Manager Beets opined that
there had been received substantial public input to-date; noting
that staff needed direction at tonight's meeting as to whether
there was a proj ect on which to hold a Public Hearing, as
outlined by State law and City Code. Mr. Beets further noted
that staff was recommending extensive legal, written notice,
beyond the 350' mandated under State Statute to be held at the
Planning Commission level, followed by the City Council level.
Councilmember Ihlan reiterated her concern that staff continue to
seek incremental guidance for various components; opining that
she was prepared to make a motion to facilitate discussion, to
hold a formal Public Hearing for the express purpose of hearing
comment on the project's financial feasibility. Councilmember
Ihlan further opined that the City Council and staff had other
issues on which to concentrate (i.e., budget) and needed to
maintain a formality in the process.
Mayor Klausing recognized Councilmember Ihlan's concern to
receive public formal input prior to the September 30, 2004
deadline outlined in the Exclusive Rights of Negotiation
Agreement between the City and Rottlund Homes as Master
