<br />City Council Regular Meeting - 09/13/04 <br />Minutes - Page 23 <br /> <br />moratorium and implications related to subdivisions, preliminary <br />and final plats. <br /> <br />Councilmember Ihlan requested that the City Council consider <br />implementation of an interim moratorium ordinance. <br /> <br />City Attorney Anderson noted, in his litigation of numerous <br />vested rights cases, he was aware of no case in Minnesota that <br />had determined vested rights existed because a permit had been <br />issued; and respectfully disagreed with Councilmember Ihlan' s <br />point. <br /> <br />Roll Call [9.2] <br />Ayes: Maschka, Kough, Schroeder and Klausing. <br />Nays: Ihlan. <br /> <br />[9.3] Schroeder moved, Kough seconded, waiving first reading, <br />holding second reading and adoption of Ordinance No. 1310 <br />entitled, "An Ordinance Amending Title 10 of the City Code, <br />Changing the Zoning Map Designation of Certain Real Property <br />at 1515 County Road Band 2194 State Farm Road from <br />Shopping Center District (SC) and Limited Business District (B- <br />1) to General Business District (B-3)." <br /> <br />Councilmember Ihlan reiterated her previous comments. <br /> <br />Councilmember Maschka expressed concern about not holding a <br />second reading; advising he would be voting against the motion <br />for that reason. <br /> <br />Roll Call <br />Ayes: Kough, Schroeder and Klausing. <br />Nays: Maschka and Ihlan. <br /> <br />City Planner Paschke reviewed the easements addressed in this <br />requested action. <br /> <br />Discussion ensued regarding traffic concerns and the process to <br />address them at this time and potential issues in the future. <br /> <br />[9.4] Schroeder moved, Maschka seconded, adoption of <br />Resolution 10242 entitled, "A Resolution Approving the <br />
