This could have a long-term negative impact on the City if it resulted in fewer <br />proposals being made for any given contract. <br /> <br />OPINION <br /> <br />Based on the forgoing, it is our opinion that the law has no explicit prohibition precluding a <br />change of legal newspapers. However, if the City did so, the Pioneer Press could have a good-faith <br />basis to bring a lawsuit clailning breach of contract and/or violation of due process. Depending on the <br />reason for the change in designation, the First Amendment may be implicated. The cost of defending <br />against any of these claims could significantly outweigh any savings of a change in designation to the <br />Roseville Review. Further, a change in designation may undemline confidence in the City Council's <br />deliberative process and its RFP process, limiting future contracting opportunities. <br /> <br />We do thank you for the opportunity to respond to this question.
