<br />Regular City Council Minutes - 3/17/03 <br />Page 16 <br /> <br />Mr. Danielson respectfully disagreed with Mr. Piernot's <br />interpretation of a lack of maintenance performed with <br />bench placements; stating that maintenance was the most <br />expensive item for his business, U. S. Bench. <br /> <br />Councilmember Klausing asked City Attorney Anderson <br />to clarify the proposed Shelter Ordinance language in <br />Section 12 regarding advertising restrictions, and whether <br />the First Amendment rights applications had been <br />considered. <br /> <br />City Attorney Anderson responded that he would review <br />that section specifically with City Attorney Squires, and <br />make a more detailed report to the City Council. <br /> <br />Mr. Len Thiele, Governmental Liaison for U. S. Bench, <br />asked for clalification regarding the public notification and <br />hearing process adhered to by the City. <br /> <br />Councilmember Klausing and City Attorney Anderson <br />responded to the process question for Mr. Thiele. <br /> <br />Ci ty Attorney Anderson pointed out several errors on the <br />draft ordinance to be noted in any action to adopt the <br />ordinance for a first reading. <br /> <br />Schroeder moved, Klausing seconded the first reading of <br />Ordinance entitled, "An Ordinance Authorizing the City to <br />Grant Non-Exclusive Transit Shelter Franchises," as <br />amended by City Attorney Anderson to correct <br />typographical errors as follows: <br />o Page 5, Section 15, Line 8, Second Sentence to <br />read, "The 'gross revenue' as used in this ordinance <br />shall mean all advertising revenue derived directly <br />or indirectly by the franchisee, its affiliates, <br />subsidiaries, apparellt [a parent company or entity], <br />or any person in which the franchisee has a financial <br /> <br />.
