Regular City Council Minutes - 3/31/03
Page 24

Mayor Kysylyczyn recognized one of those residents who
came forward following discussion of Consent Agenda,
Item XI... F... Authorizin2 Fire Department Grant
Application.

Mr. Chris Meyer, 1075 Roma Avenue (located across
the street from the proposed patio addition at 01' Mexico)

Mr. Meyer presented a bench handout by proxy from
another resident who had already left the meeting.

Mr. Meyer expressed his appreciation for the 01' Mexico
establishment in the community, but expressed his
concern regarding more clarification of alcohol and food
availability on the patio addition. Mr. Meyer asked
whether patrons could continue to meet on the patio after
the 10:00 p.m. condition, even though they were no
longer being served beverages. Mr. Meyer asked for
Council assurances that noise pollution would not be an
issue following 10:00 p.m.

Mayor Kysylyczyn reviewed several issues addressed in
the bench handout, with Council consensus that the
conditions outlined as part of the approval of the request
would address those items of concern listed in the bench
handout. (i.e., parking; emergency vehicle access in fire
lane; lighting not infringing upon residential
neighborhood; and refuse).

City Manager Beets confirmed that staff would work with
the applicant to ensure those issues were addressed to the
benefit of all property owners.

After discussion and conference with City Attorney
Anderson, it was the consensus of Councilmembers that,
without all parties being present to comment, no
additional conditions could be included or clarified.

Kysylyczyn moved, Klausing seconded, to reconsider the
Consent Agenda vote on this item as it related to the 01'
Mexico request at 1754 Lexington Avenue.
