<br />Regular City Council Minutes - 4/28/03 <br />Page 18 <br /> <br />Paschke providing clarification. <br /> <br />Councilmember Kough spoke in support of <br />continuing the item until a future meeting. <br /> <br />Mayor Kysylyczyn opined that his philosophy of <br />government was that he was not elected to be a <br />mediator, but was elected to make decisions; and <br />stated his intention to move forward and called the <br />motion. <br /> <br />Roll Call (8.1) <br />Ayes: Klausing, Schroeder, Kough and <br />Kysylyczyn. <br />Nays: Maschka. <br /> <br />(8.2) Schroeder moved, Kough seconded, adoption <br />of Resolution No. 10091 entitled, "A Resolution <br />Approving a 2 Foot Variance to Section 1004.02D5 <br />(Dwelling Dimensions - Side Yard Setback) of the <br />Roseville City Code for Property Located at 1760 <br />Dunlap Street (PF 3459)." <br /> <br />Mayor Kysylyczyn spoke regarding Minnesota State <br />Statute 462.367 related to hardships regarding the 2' <br />vanance. <br /> <br />Mr. and Mrs. Bean spoke to the proposed garage <br />width, which brings it within inches of the home <br />entry, affecting load bearing walls, and creating <br />additional main floor remodeling and moving of <br />walls; stating that the error was created in the <br />original survey, and was unique to the entire block, <br />not just their property. <br /> <br />Mayor Kysylyczyn deferred to City Attorney <br />Anderson for comment regarding State law regarding <br />hardship conditions. <br /> <br />City Attorney Anderson addressed the legality of the <br />variance hardship related to whether the application <br />was reasonable, not to determine if there were other <br />
