SURVIVAL OF COVENANTS: Any representation, warranty, covenant or agreement herein of either party to this Agreement whether to be performed before or after the closing date shall not be deemed to be merged into or waived by the instruments of closing, but shall expressly survive closing and shall be binding upon the party obligated thereby. 16.
