<br />Regular City Council Minutes - 5/12/03 <br />Page 27 <br /> <br />Attorney was to have no direct contact with any staff <br />person involved in the litigation issue. <br /> <br />City Attorney Anderson advised he would comply with <br />direction at the full vote of the Council, as their legal <br />representative; but cautioned Mayor Kysylyczyn in his <br />introduction of the motion or any participation in the <br />ensuring discussion, given possible conflict of issues that <br />may arise, given that he could potentially receive direct <br />financial benefit. <br /> <br />Mayor Kysylyczyn argued his opInIon regarding his <br />interpretation of the statute, and there being no conflict of <br />interest issues at this point in the procedure; and suggested <br />that the Attorney General or a judge be asked for their <br />legal opinion. <br /> <br />City Attorney reiterated his opinion that prior to Mayor <br />Kysylyczyn's involvement in this matter, he be allowed to <br />research the item, and provide confidential information <br />individually to each Councilmember with the issues they <br />need to consider and his findings prior to Council action. <br /> <br />Councilmember Maschka opined that in reading the <br />court's decision, there were a number of significant legal <br />issues raised and a number of unknowns; mentioned that <br />the City's ethics ordinance remained effective at this time; <br />and supported City Attorney Anderson's request. <br /> <br />City Attorney Anderson reviewed additional portions of <br />the Statute; and recommended the City Council use the <br />expertise of his firm to provide the Council with the <br />information; and if they so desired, to then seek a second <br />opinion from the Attorney General. <br /> <br />Councilmember Klausing opined his support of allowing <br />City Attorney Anderson to prepare information and his <br />interpretation of statutes for Council review as a first step. <br /> <br />Discussion ensued among Mayor Kysylyczyn <br />Councilmembers and City Attorney Anderson. <br />
