City Attorney Anderson advised he would comply with direction at the full vote of the Council, as their legal representative; but cautioned Mayor Kysylyczyn in his introduction of the motion or any participation in the ensuring discussion, given possible conflict of issues that may arise, given that he could potentially receive direct financial benefit. Mayor Kysylyczyn argued his opInIon regarding his interpretation of the statute, and there being no conflict of interest issues at this point in the procedure; and suggested that the Attorney General or a judge be asked for their legal opinion. City Attorney reiterated his opinion that prior to Mayor Kysylyczyn's involvement in this matter, he be allowed to research the item, and provide confidential information individually to each Councilmember with the issues they need to consider and his findings prior to Council action. Councilmember Maschka opined that in reading the court's decision, there were a number of significant legal issues raised and a number of unknowns; mentioned that the City's ethics ordinance remained effective at this time; and supported City Attorney Anderson's request. City Attorney Anderson reviewed additional portions of the Statute; and recommended the City Council use the expertise of his firm to provide the Council with the information; and if they so desired, to then seek a second opinion from the Attorney General. Councilmember Klausing opined his support of allowing City Attorney Anderson to prepare information and his interpretation of statutes for Council review as a first step. Discussion ensued among Mayor Kysylyczyn Councilmembers and City Attorney Anderson.
