<br />Regular City Council Minutes - 8/11/03 <br />Page 18 <br /> <br />potential conflict of interest concerns in his participation Establishment of <br />of this item; suggesting that the Mayor may wish to Council Policy <br />exclude himself from discussion. <br /> <br />City Attorney Anderson, when consulted, was unable to <br />provide a firm legal opinion on the Mayor's participation <br />and recognized potential perception of conflict of interest <br />concerns regarding disinterest beyond those of a pecuniary <br />nature. <br /> <br />Councilmember Klausing respectfully reiterated his <br />recommendation for Mayor Kysylyczyn to recuse himself <br />from this specific discussion given his closeness to the <br />situation. <br /> <br />Mayor Kysylyczyn responded likewise that perhaps <br />Councilrnernber Klausing may wish to recuse himself, <br />given his involvement with the Lawyers' Board. <br /> <br />Councilmember Klausing opined that, while Mayor <br />Kysylyczyn's involvement would be appropriate in an <br />overall policy discussion regarding outside review of <br />certain bills, he asked Mayor Kysylyczyn to reconsider his <br />participation in this particular item. <br /> <br />Mayor Kysylyczyn moved forward with discussion. <br /> <br />City Attorney Anderson cautioned a clear separation of the <br />Issues. <br /> <br />Mayor Kysylyczyn cited his concerns with people billing <br />taxpayers while using that media time and contacts for <br />their bid for public office. Mayor Kysylyczyn adamantly <br />supported the development of a policy reflecting those <br />concerns. <br /> <br />City Manager Beets advised that standard contracts with <br />attorneys require them to comply with the Lawyer's Code <br />of Ethics related to billing; as done with any professional <br />contracts and the codes of ethics that govern that <br />respective profession. <br />
