Regular City Council Minutes -10/13/03 <br />Page 5 <br />posting and advertising process and deadlines for <br />applications. Ms. Bennett noted that three (3) applications <br />had been received for the two (2) vacant positions. <br />Mayor Kysylyczyn defended the process used, in <br />accordance with adopted practices. <br />Roll Call <br />Ayes: Maschka, Klausing, Kough, Schroeder, and <br />Kysylyczyn. <br />Nays: None. <br />C. Council Vacancies and Process for Filling Vacancies <br />Councilmember Klausing noted Ms. Yates' continents <br />during the public comment portion of the meeting, seeking <br />Council discussion and City Attorney opinion. <br />Mayor Kysylyczyn noted a recent legal opinion provided <br />by counsel, current ordinance and State statute. <br />City Attorney Anderson concurred with Councilmember <br />Klausing's interpretation that the legal opinion previously <br />provided by his office only addressed current ordinance <br />and statute; and requested that his office be allowed time <br />to further research and review the issue and what was <br />needed to consider what could be changed or how such <br />changes would need to be processed from a legal <br />perspective. <br />Councilmember Klausing deferred to Mayor Kysylyczyn <br />on how he wished to respond to the public request. <br />Mayor Kysylyczyn expressed no preference. <br />Klausing moved, Maschka seconded, directing the City <br />Attorney to report at the next regular Council meeting on <br />allowances in Minnesota State Statue related to Special <br />Elections to fill City Council vacancies, and the City's <br />options in considering revisions to current processes <br />and/or policies and the timing of those provisions. <br />
