<br />Special City Council Meeting Minutes - 11/05/03 <br />Page 4 <br /> <br />Ayes: Schroeder and Kysylyczyn. <br /> <br />Nays: Maschka and Klausing. <br /> <br />Absent: Kough <br /> <br />Motion fails. <br /> <br />Counciln1en1ber Kough arrives (approx. 6:37). <br /> <br />Counciln1en1ber Schroeder n10ved, Mayor Kysylyczyn <br />seconded, a n10tion directing the City Attorney to draft an <br />ordinance establishing a special election as soon as <br />possible when a vacancy was created on the City Council <br />due to a councilmember being elected to a higher office. <br /> <br />Mayor Kysylyczyn, Counciln1en1ber Sclu'oeder and <br />Counciln1ember Kough spoke in favor of the motion as an <br />effort to get the policy-n1aking process initiated as soon as <br />possible, that the draft ordinance could be the subject of <br />public input at the council meetings on 11/17 and 11/24 <br />and possibly later, that the draft ordinance could be <br />amended at any point along the way, that this process is <br />similar to the bill drafting and public hearing process in <br />the state legislature, that Councilmember l(lausing had <br />spoken in favor of such an ordinance during his campaign, <br />and that tin1e is of the essence in getting a special election <br />ordinance enacted since a vacancy on the Council will <br />exist on January 5 and it is possible this ordinance won't <br />apply to that vacancy if the ordinance is not in effect by <br />that date. <br /> <br />Counciln1en1bers Maschka and Klausing spoke against the <br />motion, saying this special meeting was called for limited <br />purposes and this issue was not part of the call for this <br />meeting and was not on the agenda, that the City Attorney <br />was already preparing a legal opinion on this subject and <br />we ought to wait to see what that opinion says and ought <br />to receive some public comment before directing the City <br />Attorney to draft an ordinance, that the nlotion's direction <br />to the City Attorney is vague, and that the n10tion is <br />misguided in directing that the draft ordinance establish a <br />
