Mr. Neal Beets
November 20, 2003
Page 2

point out that this modification of the "Sands Version" of the Ordinance, as introduced by the
Council, develops a two-tier system for special elections. A vacancy that occurs due to an
election is subject to the 6 month time limitation, whereas all other vacancies under
Subdivision B(2), would require a special election so long as the vacancy occurs before a date
certain that need to be added to the Ordinance.

Councilmember Klausing has also requested that we draft an ordinance under which a
candidate receiving more than 50% of the votes at a special primary election would fill the
vacancy and the City would not have to hold another election. Enclosed is a draft that we
believe meets Councilmember Klausing's request, and is consistent with the law.

Please feel free to contact us if you have any further questions or comments concerning
this matter.

Very truly yours,

Jay T. Squires
Scott T. Anderson
Eric L. Hedtke

(w/encl.)

RRM:55486
