<br />City Council Regular Meeting - 03/27/06 <br />Minutes - Page 8 <br /> <br />necessary documents for execution, subject to City <br />Attorney approval as to legal form. <br /> <br />Roll Call <br />Ayes: Maschka; Pust; Ihlan; Kough and Klausing. <br />Nays: None. <br /> <br />6. <br /> <br />Recognitions, Donations, Communications <br /> <br />6.a Update on Pending Litigation, Twin Lakes <br />Redevelopment Project <br />Mayor Klausing asked City Manager Beets to update the <br />City Council and public on ongoing litigation regarding the <br />Twin Lakes Redevelopment Project; both in state court, <br />and in federal court. <br /> <br />City Manager Beets advised that the federal court case <br />consisted of a property owner on the northwest comer of <br />Fairview and the proposed Twin Lakes Boulevard, seeking <br />compensation, claiming that including the property within <br />the Twin Lakes Master Plan constituted a form of "taking" <br />within the eyes of the law. City Manager Beets advised <br />that the City's Attorneys through the League of Minnesota <br />Insurance Trust (LMCIT) requested dismissal of the case, <br />and the judge had concurred. Mr. Beets noted that the <br />property owner could appeal the decision, or take the case <br />to state court and make similar claims; however, a federal <br />judge had decided that the case didn't belong in federal <br />court. City Manager Beets noted that staff would provide <br />Councilmembers with a copy of the judgment upon receipt. <br /> <br />Ci ty Manager Beets, regarding the state court case <br />decision, noted that the City was still awaiting the case <br />decision, but it should be received within a month. <br /> <br />6.b Proclamation for Former Mayor Gale Linebarger <br />Mayor Klausing read the proclamation honoring the service <br />of former Mayor Gale Linebarger to the community and <br />region; and on behalf of the citizens, staff and City Council <br /> <br />Recognitions, <br />Donations, <br />Communications <br />
