<br />Regular City Council Minutes -12/08/03 <br />Page 17 <br /> <br />City Attorney Anderson and Development Attorney <br />Casserly concurred with the language in the MOD and the <br />Resolution as being adequate to protect City interests. <br /> <br />At the request of Councilmember Kough, Mr. Casserly <br />assured Councilmembers that they eminent domain was <br />only entertained if no other recourse was available, and <br />was not a desirable pursuit. <br /> <br />Roll Call <br />Ayes: Kough, Maschka, Klausing, Schroeder and <br />Kysylyczyn. <br />Nays: None. <br /> <br />D. Park Department's Outstanding Loans <br />Mayor K ysylyczyn referenced the issue of the Park and <br />Recreation Department's outstanding debt that had been <br />brought to attention by Mr. Sands previously. <br /> <br />Finance Director Miller confirmed that an outstanding <br />inter-department deficit in the amount of $1.2 - $1.3 <br />Million in the Recreation Fund did exist and had been <br />accumulating for a numbers of years from previous <br />administrations and Council action. <br /> <br />Mr. Miller advised that staff had been discussing the most <br />effective strategy to approach the deficit (i.e., forgive the <br />loan; recoup revenues through program fee increases), and <br />noted that whichever option was chosen would have <br />impacts. <br /> <br />Mr. Miller further advised that staff did not have a specific <br />Recommendation at this time, and that a policy discussion <br />on the City Council level would need to be held; and <br />recommended that staff be directed to develop a strategy, <br />identify funding sources, and provide options and their <br />specific ramifications to the City Council for <br />consideration. <br /> <br />Finance Director Miller noted that staff had researched <br />how and why the deficit occurred and that current staff <br /> <br />Park Department's <br />Outstanding Loans <br />
