<br />City Council Regular Meeting - OS/22/06 <br />Minutes - Page 30 <br /> <br />Roll Call [Amend to insert Item "R"] <br />Ayes: Ihlan and Kough. <br />Nays: Pust, Maschka and Klausing. <br />Motion failed. <br /> <br />Kough moved, Ihlan seconded, that the Ethics Commission <br />investigate all complaints, with one member of the Commission <br />an attorney; and that they maintained the authority to seek <br />independent legal advice; that no complaints should be <br />investigated by the City Manager or the City Attorney, as both <br />were under contract to the City; but instead, the Ethics <br />Commission should do all investigations and be given authority <br />to hire professional help if needed. <br /> <br />Councilmember Ihlan expressed her concern with the major and <br />significant debate and discussion, given the lateness of the hour, <br />and questioned how best to proceed. Councilmember Ihlan <br />opined that Council consensus may be available to reinstate the <br />Ethics Commission by ordinance; with a later discussion to <br />determine the structure and make recommendations for <br />amendment; noting that was where the former Ethics <br />Commission was at prior to being demolished; and suggested <br />they be reinstated to do that, with the assistance of outside <br />expertise as necessary (i.e., Professor Schultz); and to prepare a <br />model to the City Council. <br /> <br />After further discussion, Councilmember Kough rescinded his <br />motion. <br /> <br />Ihlan moved, Kough seconded, re-establishment of the Ethics <br />Commission; and charging them to complete their study and <br />prepare a draft Ethics Code for Council consideration. <br /> <br />Mayor Klausing spoke in opposition to the motion. <br /> <br />Roll Call <br /> <br />Ayes: Ihlan and Kough. <br />Nays: Pust; Maschka and Klausing. <br />Motion failed. <br /> <br />City Attorney Anderson suggested that individual <br />
