<br />(7) The City may seize a dangerous animal if any of the requirements <br />contained in this subdivision have not been met. A seized animal <br />may be reclaimed upon payment of impounding and confinement <br />costs and proof that the requirements of this Ordinance will be met. <br />An animal not reclaimed within seven days will be destroyed, and <br />the Owner will be liable for all costs incurred in confining and <br />disposing of the animal. <br /> <br />(8) Beginning six months after an animal is declared a dangerous <br />animal; an Owner may request annually that the City review the <br />designation. The Owner must provide evidence that the animal's <br />behavior has changed due to the animal's age, neutering, <br />environment, completion of obedience training that includes <br />modification of aggressive behavior, or other factors. If the City <br />finds sufficient evidence that the animal's behavior has changed, <br />the City may rescind the dangerous animal designation. <br /> <br />(9) Notwithstanding anything in this subdivision to the contrary, the <br />City may destroy an animal that has inflicted substantial or great <br />bodily harm on a human being on public or private property <br />without provocation. Destruction of the animal may occur after <br />the animal Owner has had a reasonable opportunity for a hearing <br />before a decision-maker appointed by the City. <br /> <br />(10) Law enforcement; exemption. Nothing contained in this <br />Ordinance shall apply to dogs used for law enforcement purposes <br />by a law enforcement agency. <br /> <br />Source: Ordinance No. 307, Third Series <br />Effective Date: 3-15-02 <br /> <br />E. Determination of Status. <br /> <br />(1) Whether an animal is "dangerous" or "potentially dangerous" as <br />that tenn is used herein shall be detennined by the Chief of Police <br />or his or her designee in consultation with the City Attorney. The <br />Owner and persons that have suffered injury or damage due to the <br />animal shall be given written notice of the determination. <br /> <br />Page 6 of6 <br />
