<br />EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 10th day of April, 2006. <br /> <br />The following members were present: Ihlan, Kough, Maschka, Pust and Klausing <br /> <br />and the following were absent: none. <br /> <br />Council Member Maschka introduced the following resolution and moved its adoption: <br /> <br />RESOLUTION NO. 10397 <br /> <br />RESOLUTION AUTHORIZING A "QUICK-TAKE" OF CERTAIN <br />PARCELS PURSUANT TO MINNESOTA STATUTES ~ 117.042 <br /> <br />BE IT RESOLVED by the City Council (the "Council") of the City of Roseville, Minnesota (the <br />"City"), as follows: <br /> <br />Section 1. <br /> <br />Recitals. <br /> <br />1.01 That the City Council of the City of Roseville did authorize the acquisition of <br />certain property for public use by right of eminent domain pursuant to its Resolution No. 10367; <br />and <br /> <br />1.02 In order to commence construction of certain roadways provided for in the <br />Contract for Private Redevelopment by and between the City of Roseville, Minnesota and <br />Roseville Twin Lakes, LLC dated as of September 9, 2005 (the "Contract"), certain of those <br />parcels must be acquired by the "quick take" process provided for in Minnesota Statutes S <br />117.042, said parcels are legally described on Exhibit A, attached hereto and incorporated herein <br />by reference. <br /> <br />Section 2. <br /> <br />Authorization. <br /> <br />2.01 Pursuant to the above-referenced Contract, the City does hereby authorize and <br />direct its attorneys, Krass Monroe, P.A., and staff to proceed immediately to acquire certain of <br />the subject properties identified in Resolution No. 10367 pursuant to Minnesota Statutes S <br />117.042. The appraisals for the properties listed on Exhibit A, prepared by the firm of Dahlen, <br />Dwyer & Foley, Inc. are hereby in all respects approved. <br /> <br />Adopted by the Council of the City this 10th day of April, 2006. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Mayor Klausing <br />and, upon vote being taken thereon, the following voted in favor thereof: Maschka, Pust; Mayor <br />Klausing; the following abstained: Councilmember Kough; <br />and the following voted against: Ihlan. <br />
