<br />REQUEST FOR COUNCIL ACTION <br />Date: 4-23-12 <br />Item No.: <br />12.c <br />Department Approval City Manager Approval <br />Community Development Department Request to Perform an Abatement <br />Item Description: <br />for Unresolved Violations of City Code at 1535 Sextant Avenue. <br />B <br />ACKGROUND <br />1 <br /> The subject property is a single family home which is currently being rented. <br />2 <br /> The current owners are James and Debra Cox, 2 Peterson Place, North Oaks, MN 55127. <br />3 <br /> Current violation includes: <br />4 <br /> Outside storage of fencing materials (violation of City Code Section 407.02.D, Junk and <br />o <br />5 <br />Debris). <br />6 <br /> <br />7 <br /> A status update, including pictures, will be provided at the public hearing. <br />8 <br />PO <br />OLICY BJECTIVE <br />9 <br />Property maintenance through City abatement activities is a key tool to preserving high-quality <br />10 <br />residential neighbo <br />11 <br />support property maintenance as a means by which to achieve neighborhood stability. The Housing <br />12 <br />e and well- <br />13 <br />14 <br />15 <br />specific policies related to property maintenance <br />16 <br />and code compliance. Policy 6.1 of Chapter 3 states that the City should promote maintenance and <br />17 <br />reinvestment in housing and Policy 2.6 of Chapter 6 guides the City to use code-compliance activities <br />18 <br />as one method to prevent neighborhood decline. <br />19 <br />FI <br />INANCIAL MPACTS <br />20 <br />City Abatement: <br />21 <br />An abatement would encompass the following: <br />22 <br />Removal of the fencing materials: $ 600.00 <br /> <br />23 <br /> Total: Approximately $ 600.00 <br /> <br />24 <br />25 <br />In the short term, costs of the abatement will be paid out of the HRA budget, which has allocated <br />26 <br />$100,000 for abatement activities. The property owner will then be billed for actual and administrative <br />27 <br />costs. If charges are not paid, staff is to recover costs as specified in Section 407.07B.
