<br />Section 10: Removal of a non-conforming land use: This is discussed above under the section labeled, "some changes in the <br />bill." <br /> <br />Section II: Compensation for loss of going concern: This section provides the owner of a business or trade compensation <br />for loss of going concern related to taking of real property. The section also explains the process involved and outlines <br />considerations that must be taken into account. <br /> <br />Section 12: Minimum compensation: This requires compensation to allow the owner to purchase a comparable property in <br />the community. <br /> <br />Section 13: LimitationS: This prohibits a condemning authority from requiring an owner to accept as compensation a <br />substitute property or return of property taken. <br /> <br />Section 14: Public service corporations exemptions -- This provides that the provisions for attorneys' fees (section 4), <br />compensation for loss of going concern (section I I), minimum compensation (section 10), and limitations (section II), do <br />not apply to public service corporations. Additionally, appraisal fees may not exceed $500 for all types of property. <br /> <br />Section 15: First right ofrefusal: This item requires property acquired by condemnation that is no longer needed by the <br />condemning authority to be offered back to the person from whom it was acquired, ifthe person can be located, at the lower <br />of the original price or the current fair market value. <br /> <br />Sections 16 and 17: Relocation assistance - Section 16 deletes the following sentence from current law: "An acquiring <br />authority may consider reimbursing up to $50,000 in reestablishment expenses of a displaced business." Section 17 updates <br />references to federal regulations. <br /> <br />Section 18: Relocation benefits - Relocation benefits for a displaced business have a maximum of $50,000. <br /> <br />Section 19: Relocation assistance determined bv an administrative law iudge <br /> <br />Section 20: Revisor's instruction. This section directs the Revisor to change "right of eminent domain" to "power of eminent <br />domain" in statutes and rules. <br /> <br />Section 21: Repealer - This section repeals Minn.
