<br />City Council Regular Meeting - 07/10/06 <br />Minutes - Page 31 <br /> <br />Discussion ensued regarding the mInImum versus <br />maximum fine to apply. <br /> <br />Roll Call <br />Ayes: Pust and Maschka. <br />Nays: Kough; Ihlan and Klausing. <br />Motion failed. <br /> <br />Ihlan moved, Kough seconded, amending the motion to <br />include provision that the City refund the previous fine <br />already collected, in the case of those businesses paying <br />charitable donations (i.e., Green Mill and Old Chicago). <br /> <br />Councilmember Maschka opined that a larger fiasco was <br />being created than what was attempting to be rectified; and <br />overshadowing the message the City Council wanted to <br />emphasize in not tolerating serving alcohol to minors. <br /> <br />Roll Call <br />Ayes: Kough and Ihlan. <br />Nays: Pust; Maschka and Klausing. <br />Motion failed. <br /> <br />City Attorney Anderson cautioned that any deviation by the <br />City Council needed to be supported in writing; and <br />findings outlined applying a more stringent penalty adding <br />a one-day suspension; suggesting that City Manager Beets' <br />original letters and findings could be used as a sample for <br />language inclusion in applicable motions. <br /> <br />Councilmember Ihlan spoke in opposition to the original <br />motion, as without amendment, she opined that it had been <br />turned into something she couldn't support; seeking <br />mandatory minimum fine and a mandatory one-day <br />suspensIOn. <br /> <br />Klausing moved, Ihlan seconded, to reconsider the motion <br />to refund the charitable contribution portion of the fine as <br />applicable. <br /> <br />Roll Call <br />Ayes: Kough; Ihlan and Klausing. <br />
