City Council Regular Meeting - 08/14/06
Minutes - Page 16

September 22, 2006 as Roseville Kiwanis Peanut Day.

7.

Consider the Request by Walser Automotive Group for a
CONDITIONAL USE PERMIT to allow the redevelopment
of the former Wally McCarthy GMC/Pontiac facility at 2775
Highway 35-W (PF 3775)
City Planner Thomas Paschke reviewed the request of Walser
Automotive Group for a Conditional Use Permit to redevelop the
former McCarthy Pontiac GMC into a new 48,581 square foot
Buick, Pontiac, and GMC Truck dealership that would include a
two-story office/showroom area, service write up area, parts and
service shop, as well as a carwash.

Mr. Paschke reviewed the process to-date; the Public Hearing
held on July 12, 2006 by the Roseville Planning Commission,
and their recommendation on a 4/1 vote to recommend approval,
subject to conditions.

Mr. Paschke noted that, while the initial site plan indicated a
parking lot that met the required setback, except along Long
Lake Road, the plan had since been revised, and the southern
parking lot proposal indicates an encroachment into the adjacent
parcel, which encroachment is prohibited and would require a
VARIANCE in order to allow it. Mr. Paschke further noted that,
the adjacent southern pond experienced periodic flooding, and
under City Code, a storm water pond requiring a minimum ten
foot (10') setback from the ordinary high water elevation of the
pond would be required.

Mr. Paschke addressed meetings with staff, the applicant's
representative, and adjacent property owner Jerry Golinvaux of
Roseville Chrysler Jeep, and compromises and discussions to
work out an acceptable redevelopment plan and to address
concerns regarding structure location and size. Mr. Paschke
advised that the City Attorney had reviewed a lease document
between McCarthy and the Minnesota Department of
Transportation (MnDOT _ and concluded that a V ARIANCE was
necessary to extend the parking lot within the required parking
setback and across the southern property line.

Staff recommended approval of the application, based on

Resolution 10423
Walser Automotive
Group CUP
2775 Hwy 35- W
(PF 3775)
