<br />City Council Regular Meeting - 09/11/06 <br />Minutes - Page 19 <br /> <br />Councilmember Kough expressed his ongoing concern that the <br />HRA had assisted in funding, originally set aside for rental <br />housing licensing, to assist with the community visioning process. <br /> <br />Roll Call [HRA] <br />Ayes: Maschka; Ihlan; Kough; Pust and Klausing. <br />Nays: None. <br /> <br />9. <br /> <br />Discussion on Various Twin Lakes Development Options <br />including Environmental Impacts and Studies <br />Community Development Director John Stark provided a <br />historical perspective on the Twin Lakes Development Area, and <br />sought options for providing staff with policy-level guidance in <br />pursuing future outcomes for that area. <br /> <br />Staff reviewed the litigation issues; recent Court of Appeals' <br />ruling; decision by the City Council to seek Minnesota Supreme <br />Court appeal for the Court of Appeals' ruling; and impacts to <br />various components of the redevelopment project. Mr. Stark <br />noted that a delay in the redevelopment project of up to one year, <br />while awaiting a Supreme Court ruling if they accept the petition <br />for review, could have negative impacts for the City and <br />Developer, including legal and financial exposures associated <br />with the City's Quick-Take Condemnation activities in the area <br />(i.e., relocation claims, loss of going concern claims, damages, <br />etc.) and other land-use approval requests. <br /> <br />Mr. Stark reviewed the potential negative impacts, and options <br />being recommended for consideration by staff as follows: <br />a) Adopt the modified master plan (the 2005 Master Plan) into <br />the approved master plan (the 2001 Master Plan) and/or the <br />Comprehensive Plan. <br />b) Formally amend any past action that may be interpreted as <br />adopting the 2001 Master Plan via reference into the <br />Comprehensive Plan and analyze the potential for the <br />current development proposal to be considered sufficiently <br />consistent with the underlying Comprehensive Plan <br />designation("BP). <br />c) Operate under the Court of Appeals' opinion that the 2005 <br />master Plan is "ineffective," and determine whether the <br />appropriate Comprehensive Plan designation for the area is <br /> <br />Discussion on <br />Various Twin <br />Lakes Development <br />Options including <br />Environmental <br />Impacts and <br />Studies <br />
