<br />City Council Regular Meeting - 09/11/06 <br />Minutes - Page 21 <br /> <br />encouraged the developer to return with a development plan that <br />was agreeable to the super-majority Council and the community. <br /> <br />Councilmember Pust clarified concerns that the developer could <br />come forward with another proposal and staff would not know <br />how to respond or what designated plan governed the City at this <br />time. Councilmember Pust opined that the 2005 Master Plan <br />should no longer be under consideration; and supported staff's <br />request for direction from the City Council. <br /> <br />Staff recommended that the City Council direct staff to further <br />analyze the actions required (if any) to unequivocally designate <br />the Twin Lakes development area as "BP - Business Park" as <br />described in the Comprehensive Plan and react to the current <br />development plan, or any future development plan, on that basis. <br />Further, to direct staff to process any pending land use <br />applications for the Twin Lakes area as is prescribed in City <br />ordinance and to pursue (with further City Council consideration <br />as prescribed) the necessary environmental review associated with <br />processing such applications. Mr. Stark reviewed staff's rationale <br />and basis for this recommendation: <br />· Roseville Twin Lakes, LLC (the Developer) has ownership <br />interests in parcels in the Twin Lakes area. This position <br />affords them the right to seek land use approvals for the <br />site, including, but not limited to, environmental review and <br />rezonmg; <br />· If an application is made for such approvals, the City is <br />legally required to respond to such applications within 60 <br />days of their receipt; <br />· The City's response to such application will rely, to some <br />degree, upon the underlying Comprehensive Plan <br />designation for the area; <br />· Based on a review of historical documents, it is the staff's <br />contention that a Comprehensive Plan designation of "BP- <br />Business Park" was intended as the land use guide for the <br />area by City staff and elected officials and by the <br />Metropolitan Council. <br /> <br />. <br /> <br />Mr. Stark advised that staff had engaged the Metropolitan Council <br />in internal staff and attorney discussions for their unbiased <br />opmlOn. <br />
