<br />EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 25th day of September, 2006, at 6:00 <br />p.m. <br /> <br />The following members were present: Thlan, Kough, Maschka, Pust and Mayor Klausing; <br />and the following were absent: none. <br /> <br />Council Member Maschka introduced the following resolution and moved its adoption: <br /> <br />RESOLUTION NO. 10435 <br /> <br />A RESOLUTION APPROVING THE VACATION OF THE SANITARY SEWER <br />EASEMENT ON CERTAIN UNDEVELOPED RESIDENTIAL LOTS (PF3759) <br /> <br />WHEREAS, J.W. Moore, Inc. and Keller-Williams Realty have requested the vacation of <br />the above-referenced sanitary sewer easement; and <br /> <br />WHEREAS, the easement is currently located on the property that is legally described as: <br /> <br />LOTS 14 THROUGH 19, BLOCK 4, ROLLING GREEN <br />PIN: 13-29-23-31-0079 and 0080 and <br />PIN: 13-29-23-320002 through 0005 <br /> <br />WHEREAS, the Public Works Department has determined that the easement subject to <br />the request may be vacated if the existing sanitary sewer main is appropriately relocated, rebuilt, <br />and protected by a new easement; and <br /> <br />WHEREAS, the Roseville Planning Commission held a public hearing regarding the <br />Sanitary Sewer Easement Vacation requested by the applicants and voted (5-0) to recommend <br />approval of the vacation, based on the findings of Section 5 of the Planning Commission proj ect <br />report dated September 6, 2006 and the conditions as amended by the Planning Commission and <br />written in Section 7.2 ofthe City Council project report dated September 25,2006; <br /> <br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to grant the <br />SANITARY SEWER EASEMENT VACATION on the above identified properties, based on the <br />findings in Sections 5 and 6 of the project report dated September 25, 2006, and subject to the <br />following conditions: <br /> <br />1. The existing sanitary sewer must be relocated and constructed, through a Public <br />Improvement Contract, in compliance with City standards. <br /> <br />2. A new sanitary sewer easement must be established in compliance with City <br />Standards. <br /> <br />1 <br />
